Agreement to terms
These Terms of Service ("Terms") govern your use of the EXV website at https://exvmedia.com (the "Site") and your engagement of our video production and creative services (the "Services"). By using the Site or engaging us for Services, you agree to these Terms. If you do not agree, do not use the Site or engage our Services.
Who we are
EXV is a video production company. You can reach us through the form on our contact page.
Use of the site
- You must be at least 18 years old, or the age of majority in your jurisdiction, to use this Site.
- You agree to provide accurate information in any form you submit and not to impersonate any person or entity.
- You will not use the Site to transmit unlawful, infringing, or harmful content, attempt to gain unauthorized access to our systems, or interfere with the Site's operation.
Services and engagements
Inquiries submitted through the Site (fit calls, quote requests, briefs) are not a binding commitment by either party. A production engagement, its scope, pricing, timeline, and deliverables are governed by a separate signed agreement or statement of work between you and EXV. Where these Terms and a signed agreement conflict for a given engagement, the signed agreement controls.
On-time guarantee
Your film arrives on the date in your contract, or 20% comes off your final invoice. We would rather hand you the film than a discount.
These terms explain how the guarantee works.
1. What's covered. The guarantee covers the delivery date of the main film in your signed project plan. If your plan names more than one main film, each one's date is covered. The other finished pieces have their own dates in the plan, and the guarantee does not apply to them. A film counts as delivered when we send you the download link for the agreed version.
2. What you get if we're late. You pay half of the fee when you sign your plan and the other half, your final invoice, when we deliver. If a main film arrives after its date, we take 20% off that final invoice.
3. Once per project. The 20% applies once per project, however many main films are late.
4. Dates move with inputs. Your plan lists what we need from you and when, for example script sign-off, feedback, your brand files and time with anyone who appears on camera. If something we need arrives late, each later date shifts by as many days as the delay, and we confirm the new dates in writing.
5. Changes you ask for. If you change what the project includes after signing, we agree new dates with you in writing before that work starts. The guarantee then applies to the new dates.
6. How to claim. There's nothing to file. If the main film is late, we take the 20% off your final invoice, without you having to ask.
Intellectual property
- The Site's design, text, and branding are owned by EXV or its licensors and may not be copied or reused without permission.
- Ownership and licensing of video deliverables produced for a client are set out in that client's signed production agreement, not by these Terms.
Communications
If you opt in to email updates, our consent, use, and unsubscribe practices are described in our Privacy Policy.
Disclaimers
The Site is provided "as is" without warranties of any kind, express or implied. We do not guarantee the Site will be uninterrupted, error-free, or secure.
Limitation of liability
To the fullest extent permitted by law, EXV is not liable for indirect, incidental, or consequential damages arising from your use of the Site. Liability arising from a production engagement is governed by that engagement's signed agreement.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.
Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by the "last updated" date above.
